The Article 29 Working Party (‘WP29‘) has recently adopted and subsequently finalised its long-awaited guidelines on Consent as well as those on Transparency under Regulation 2016/679 (the ‘GDPR‘). These long-awaited guidelines form part of the many GDPR related guidelines, opinions and recommendations issued by the WP29 aimed to help practitioners, controllers and processors alike to better understand the workings and intricacies of the imminent GDPR. These guidelines substantially expand on the notions of Consent and Transparency, going beyond what is merely contained in the law.
Although strictly speaking they are not considered ‘law’, guidelines and opinions of the WP29 are given considerable importance when it comes to the interpretation and implementation of the law.
